scene.org acting like a criminal, refusing to remove my files

category: residue [glöplog]

I see that my tracks are still up. Get them down.

btw, your tracks are crap.

tmplog, I see that you still have not sent us the small mail which will let us remove the files.

If you can't state the reason for removing your tracks because it's too shameful for you, it's precisely why we ask for a private mail, mind you.

The tracks are illegal for you to distribute.

I have already talked to crown about this. We agreed that he'd take down the files.

Ok so you want to make it public.

Why are they illegal for us to distribute? Because they are counterfeit from tracks from other people, that you were not yourself allowed to upload?

As far as I can see this discussion does not apply to the tracks you submitted in various competitions in the past, by the way.

I did not want to make anything public. I send you first a notice, by scene.org's ftp. Files have been removed before, by this method. Then I sendt you cease and desist letters. I have also not signed any contract with you. The webspace was granted me after an IRC talk to "redhound". (because I was a known scener). Althought that you treat your own like this, is unbelievable. Not only do I get slandered in your forums, but I guess you were the same ones on KvR. Btw, your contract, is by itself illegal.

a known scener?

You did not want to make anything public but you have posted those files yourself, and posted the links over the internet? You cannot claim this in any reasonable manners.

Due to your efforts some of those files were downloaded in great numbers.

So, all in all, we did not make your files public, you did. And since 2001. You cannot claim now you never *intended* this.

Your application form dates back to August 17th 2001. It features your very personal details. Such as fullname, email and personal address at the time.

You claim to have been granted webspace, you never had. Your application form was for "music space" on our archive.

You claim to be slaundered in our forums:
- these forums are not ours
- you slaundered scene.org in this very thread
- you have been: menacing people, issuing death threats and insulting others. (All the while displaying bigotry against sexual minorities)

You even do so while we were offering to resolve the issue privately.

We have nothing to do with KvR, or the numerous disputes you have engaged in on the internet. We have nothing to do with your own personal problems, your fears and inadequacies. We have nothing to do with your inability to talk with people in the manner you expect to be treated. If you want to claim you never existed, and that your past has never happened, it's your own problem.

You appeal to law without precision on what laws are being broken, thus not letting us judge the validity of your claims.

magic:

Ove Karlsen
used the handle: B.I.T. of EON

You can find modules of him on pages he hasn't attacked yet. Or on CD compilations.

Am I talking to some stubborn idiot?

I have a feeling knos is asking himself the same right now :)

tmplog, the idea is that if you want your files removed, you send an e-mail with the reason to do so to the scene.org staff. The cease-and-desist approach doesn't work here as you might have noticed (perhaps partly because you keep claiming scene.org is behaving illegally, yet do nowhere explicitly state what laws they are supposedly breaking).

Simple as that, yeah.

magic: curiousity kills the cat... in fact one should be blind to still not get the handle of the guy...

that said, i don't see anything illegal with the "contract" between you and scene.org. when you submit a file you accepted an agreement (= contract), you give certain people the rights to distribute, share and copy your work. maybe demoscene productions are not totally public domain, but the logic behind the distribution system is almost the same.

if i were you, i'd send scene.org a letter that's not full of insults and especially "cease and desist" stuff... i'm quite sure they're trying to help as long as you specify the correct reasons for the removal of your files. on the other had, know that this is not going anywhere like this, just a vicious circle...

Calling me a troll, when he himself is the troll.
added on the 2008-07-06 14:18:38 by tmplog tmplog
Not really. A troll understand the other's people motives and intentionally take them into account. Here it's very different.
