I think this is interesting in this discussion.

xernobyl: the thing with the amen break is interesting, I make dnb but came from the jungle and hardcore (no, the music sort!) /rave scene. only 6 seconds of sound, but a lot of impact is made the backbone of a lot of tunes and for some reason very easy to fit to tempos etc.

Yes Gregory C. Coleman from the winstons, could have chased it up, but never did, he got disheartned with music biz. he died last year R.I.P, but the break remains his legacy.

it's been used pretty wide spread. From hip hop, to dnb .. and even the tv show futurama, features the break.

So when people in say hip hop etc, were using it he could have taken action but never did. So others did, and it sorta became public domain due to that. by using it , you pretty much knew people wouldn't be chasing you for money.

also they were chopping up the break later on and doing constructive sampling, not just playing it straight. unlike other people who rip off melody's so blatenty and don't credit. (no prize for guessing who ;-) )

as for the funky drummer break, people have used it and been chased for it. So one to avoid sampling ;-)

okkie : more interesting, elements of the amen.. at least its actually constructive sampling, making something different/creativity. I don't know what year things changed, but if you listen to older records you can notice some iffy samples. thing remains for me, at least it was constructive and not just a straight rip.

within d&b the odd time people sample other peoples records within the genre, the paris break being another one. As long as it don't form the bulk of a tune, most don't mind.

theres loads of hybrid ones though. Coleman didn't get paid so i think it was his 2 fingers up to the industry.

Latest issue of Rumba (Finnish music magazine) has one-page article about Timbaland case. They had interviewed Timbaland and he told that he doesn't see sampling as thievery, but as a way of showing respect to original artists. Timbaland also said his sampling can introduce lesser known artists to bigger audiences (and gave one artist (can't remember the name) as an example).

Well, there is some kind of logic, but.... without crediting I can't see there any given respect or publicity for the original artist.

hmm from what dafred writes, it seems like an interesting change of tone on Timbo's part: from dismissing the value of Janne's work and deriding him as a 'video game idiot' he shifted towards 'giving publicity' and 'showing respect' ... Maybe his lawyers managed to persuade him that he is in for a rough landing?

Or he might be reasoning that he has no face left to lose in Finland and has to be somewhat humble, while in the US he has a large amount of fans that doesn't care if he did something wrong as long as he is the King. And it is not fitting for a king to be modest or admit wrongdoing.

or he's not reasoning at all and the interview was with a pr person.
